Terms of Service

ChromaGain (the website chromagain.com and the mobile apps) is provided by the ChromaGain team ("ChromaGain", "we", "us"). Contact: chromagain.team@gmail.com. Using the service means you accept these terms in full. If you do not agree, do not use the service.

1. The service

ChromaGain is a colour record-keeping tool: it lets you file the colour, brand, product line, finish and code of every painted surface across your properties and rooms, attach photos, organise palettes and painting schedules, and consult manufacturer fan decks for reference. It is delivered on the web and through apps for Android and iOS.

The service is under active development. Features may be added, changed or removed. We will try to announce material changes, but this is not a commitment to uninterrupted availability.

2. Your account

  • You need an account with a valid email address. You must be at least 18, or have your guardian's consent.
  • You are responsible for keeping your credentials secure and for everything done through your account.
  • The details you provide must be accurate and kept up to date.
  • You can request deletion of your account through the contact form or at chromagain.team@gmail.com; it is completed within 30 days and removes your data as described in the Privacy Policy.

3. Acceptable use

When using the service you agree that you will not:

  • break the law or infringe the rights of others;
  • upload content that is unlawful or offensive, or that you do not have the rights to (for example, other people's photos without permission);
  • access the service by automated means (scraping, bots), create records in bulk, or try to circumvent usage limits, security measures or authentication;
  • attempt to reverse-engineer, copy or extract the colour databases and fan decks for your own distribution or commercial use;
  • place an unreasonable load on the infrastructure, or interfere with the service for other users;
  • resell or grant access to the service without our written permission.

We may suspend or terminate an account that breaches these terms, with notice where reasonably possible.

4. Free use and limits

Basic use is free, subject to quantity limits — currently, as an indication: up to 10 properties, up to 10 rooms per property and up to 15 surfaces per room. Deleting a record frees its slot. The limits are described in the app and may be adjusted with reasonable notice.

5. The "Unlimited" subscription

  • What it includes: removal of the limits above and any additional features described as part of the subscription.
  • Price: the price shown at checkout. Currently €9.99 per year (including VAT where applicable).
  • Billing and renewal: payment is handled by our payment provider Stripe. The subscription renews automatically at the end of each yearly period, charging your saved payment method, unless you cancel before the renewal date.
  • Cancellation: you can cancel any time from the billing portal (Settings → Billing). Cancellation takes effect at the end of the current period; you keep access until then.
  • Downgrade: after a subscription ends, your data stays, but if it exceeds the free limits you will not be able to add new records until you reduce the count or renew.
  • Mobile apps: due to app-store policies, buying and managing the subscription happens on the website only. In the apps the plan is shown for information.
  • Price changes: any change to the price will be notified to you before it takes effect and will apply only from the next renewal.

6. Right of withdrawal and refunds

As a consumer in the EU you generally have a 14-day right to withdraw from the subscription after it is entered into. Because the service is activated immediately, by requesting immediate access you consent to performance beginning within the withdrawal period.

Regardless of the above, we offer a full refund within 14 days of your first subscription purchase if you are not satisfied — email chromagain.team@gmail.com. Renewals are not refundable once charged, but you can cancel to avoid the next one.

7. Your content

The records, notes and photos you upload remain yours. You grant us a limited licence to store, process and display them solely to operate the service for you (for example, generating signed links for your photos, and share links that you enable).

You confirm that you have the right to upload each photo and that it does not infringe the rights of others. We do not use your content for advertising and we do not sell it.

8. Intellectual property

The ChromaGain software, design, logos and content are protected and belong to us or our licensors. You are granted no rights beyond using the service in accordance with these terms.

Paint manufacturers' colour names, codes and fan decks belong to their respective owners and are provided within the service for reference and shade identification only. On-screen colours are indicative.

9. Third-party services

We rely on third-party providers to run the service — including hosting and database, file storage, payment processing (Stripe) and email delivery. Data processing is described in the Privacy Policy. Payments are additionally subject to Stripe's terms.

10. Disclaimer

The service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or fully secure, nor that colours, codes, LRV values or fan decks are exact. Before any purchase or painting, confirm the shade against a physical sample. You are solely responsible for backing up any data you consider critical.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of data, profit or time. Our total liability for any claim relating to the service is limited to the amount you paid for the subscription in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be excluded by law (for example, wilful misconduct, gross negligence, personal injury, or your mandatory consumer rights).

12. Suspension and termination

You can stop using the service at any time. We may suspend or terminate your access if you breach the terms, if required by law, or if we discontinue the service as a whole — in that last case, with reasonable notice and the opportunity to export your data.

13. Changes to these terms

We may update these terms. For material changes we will notify you (for example, by email or an in-app message) before they take effect. Continuing to use the service after the effective date constitutes acceptance.

14. Governing law and jurisdiction

These terms are governed by Greek law. The courts of Thessaloniki, Greece, have jurisdiction over disputes, without prejudice to any mandatory right you have as a consumer to bring proceedings in the courts of your place of residence.
